According to Article 32 of the Constitution of Kyrgyzstan and Article 137 of the Family Code, assisted reproductive technologies (including commercial surrogacy) are defined as legal medical procedures, and they clearly protect the parent-child relationship between the commissioning parents and the child born through surrogacy.

If there is already an embryo, how does surrogacy work?

The average duration is 13-16 months, which is divided into stages: 1. Matching Surrogates + Legal Registration: 1-2 months; 2. Embryo Transplant (including preparation for pregnancy): 2-3 months; 3. Pregnancy Period (including prenatal checkups): 9 months; 4. Document Processing post-birth: 1-2 weeks; 5. Accelerated Option: Frozen embryo transplant can be shortened to 12-15 months.

How to ensure cross-border custody after a child's birth?

The Ministry of Justice of Kyrgyzstan offers three layers of protection: - Dates of birth are directly annotated with the names of the custodial parents (without the need for genetic linkage); - A court issues a Certificate of Parent-Child Relationship, which is certified by the Ministry of Foreign Affairs; - Assists in processing an International Order for the Transfer of Guardianship, seamlessly aligning with the national laws (like the 1073 clause of China’s Civil Code).
